1 Acceptance of Terms
By downloading, installing, accessing, or using the GazeWell mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Veeresh Kumbar ("Developer," "we," "our," or "us").
GazeWell is intended for use by adults (18 years or older) who are parents, guardians, or caregivers of infants and young children.
2 Description of Service
GazeWell is a mobile application that provides the following features:
- Infant Vision Simulator: A camera-based tool that applies scientifically-informed filters to approximate how infants see at various ages, based on published research on visual acuity, colour perception, and contrast sensitivity development.
- Growth Tracking: Tools to record and monitor your baby's weight, height, and head circumference over time.
- Milestone Tracking: A system to track your baby's developmental milestones across motor, cognitive, social, and language categories.
- Memory Journal: A photo and note journal to capture and preserve meaningful moments.
- Development Information: Age-appropriate developmental stage information based on established paediatric research.
3 Account Registration
To use GazeWell, you must create an account using your phone number. You agree to:
- Provide accurate and current information during registration
- Maintain the security of your account credentials
- Promptly notify us of any unauthorised access to your account
- Be responsible for all activities that occur under your account
We reserve the right to suspend or terminate accounts that violate these Terms.
4 User Content
You retain ownership of all content you create or upload through the App, including:
- Baby photos and profile images
- Growth measurements and data entries
- Milestone records and notes
- Memory journal entries, photos, and descriptions
By using the App, you grant us a limited, non-exclusive licence to store, process, and display your content solely for the purpose of providing the App's services to you. We will never use your content for advertising, marketing, or any purpose unrelated to providing the service.
5 Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable laws
- Attempt to reverse engineer, decompile, or disassemble the App
- Interfere with or disrupt the App's servers or networks
- Upload malicious code, viruses, or harmful content
- Use the App to collect data about other users without their consent
- Impersonate any person or entity
- Use automated systems or bots to access the App
- Attempt to gain unauthorised access to any portion of the App
6 Infant Vision Simulator Disclaimer
The Infant Vision Simulator feature is designed for educational and informational purposes only.
- The simulation does not represent the exact visual experience of any individual infant. Every baby develops differently.
- The simulator should not be used as a diagnostic tool for vision problems or developmental delays.
- If you have concerns about your baby's vision or development, please consult a qualified paediatrician or paediatric ophthalmologist.
- Camera frames are processed entirely on-device and are never stored, recorded, or transmitted.
7 Medical Disclaimer
GazeWell is not a medical device and does not provide medical advice, diagnosis, or treatment.
- Growth percentiles, milestone timelines, and developmental stage information are provided for general informational purposes only.
- This information should not replace professional medical advice from your paediatrician or healthcare provider.
- Always consult a qualified healthcare professional for medical decisions regarding your child.
- If you believe your child has a medical emergency, contact your local emergency services immediately.
- We do not guarantee the accuracy, completeness, or usefulness of any developmental information provided.
8 Intellectual Property
The GazeWell App, including its design, code, graphics, icons, interfaces, and content (excluding User Content), is the intellectual property of Veeresh Kumbar and is protected by copyright and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App on your personal device for its intended purpose.
You may not:
- Copy, modify, or distribute the App or any part of it
- Use the App's branding, logos, or design elements without written permission
- Create derivative works based on the App
9 Privacy
Your use of GazeWell is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. The Privacy Policy is incorporated into these Terms by reference.
By using the App, you consent to the data practices described in our Privacy Policy.
10 Push Notifications
GazeWell may send push notifications including:
- Growth measurement reminders
- Milestone achievement alerts
- Weekly developmental update summaries
- App updates and new feature announcements
You can manage your notification preferences within the App's Profile settings or through your device's notification settings at any time.
11 Service Availability
We strive to keep GazeWell available at all times, but we do not guarantee uninterrupted access. The App may be temporarily unavailable due to:
- Scheduled or emergency maintenance
- Server or infrastructure issues
- Internet connectivity problems
- Force majeure events
We will make reasonable efforts to notify you of planned downtime in advance.
12 Limitation of Liability
To the maximum extent permitted by applicable law:
- The application is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.
- We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
- Our total liability for any claim arising from your use of the App shall not exceed the amount you paid for the App (if any) in the 12 months preceding the claim.
- We are not responsible for any decisions you make based on information provided by the App.
13 Indemnification
You agree to indemnify, defend, and hold harmless Veeresh Kumbar from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights
- Content you submit through the App
14 Account Termination
You may delete your account at any time through the App's Profile settings. Upon account deletion:
- Your personal data will be deleted within 30 days
- Your baby's data, growth records, milestones, and memories will be permanently removed
- Photos will be deleted from cloud storage
- This action is irreversible
We may terminate or suspend your account if you violate these Terms, with or without prior notice.
15 Changes to Terms
We reserve the right to modify these Terms at any time. When we make changes:
- Updated Terms will be posted within the App
- The "Effective Date" will be updated
- For material changes, we will provide notice via the App or push notification
Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
16 Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law provisions.
Any disputes arising from these Terms or your use of the App shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the jurisdiction of the courts in Bangalore, Karnataka, India.
17 Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
18 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Veeresh Kumbar regarding your use of GazeWell.
These Terms supersede any prior agreements, communications, or understandings regarding the App.
